NEW CDL DRIVER QUALIFICATION REQUIREMENT

NOTICE: The Part 380 "new CDL" driver qualification training requirement is in effect for all NEW (drivers obtaining a CDL after July 20, 2003) interstate Commercial Drivers License (C.D.L.) drivers (per 49 C.F.R. Part 380 (E)). Several states have adopted the Part 380(E) driver qualification requirement for ALL new intrastate CDL drivers (see links below).

ALL inter-state CDL drivers with a "NEW" Commercial Drivers License (drivers obtaining a CDL after July 20, 2003) and several states' INTRA-STATE CDL drivers, to be properly and legally qualified, need to have training in these four areas required by 49 C.F.R. Part 380 Subpart E.:


  • Driver's Hours of Service/Logbook Training (Revised for Oct. 1, 2005)
  • CDL requirements (including the 'new' Part 383)
  • Whistleblower Protection (Public Interest Disclosure)
  • Health and Wellness
Enforcement of the Federal rule began January 2005.

Colorado had a July 1, 2004 deadline for all INTRAstate drivers. Illinois' INTRAstate requirement was in place as of November 10, 2005. TEXAS had a July 31, 2005 deadline for all NEW INTRA-STATE CDL drivers.

Note: a "new" driver is a CDL driver obtaining a CDL after July 20, 2003. Check your drivers' files!!

Obtain the Part 380 driver qualification training guide and exercises below. Our Instructional Help Desk is available 9AM-5PM EST: should the driver have any questions, he or she may call Toll-free or e-mail a licensed instructor.

After the driver completes the assessments, 1.) you may grade the exercises, score and issue a certificate (order below) or 2.) fill out the order form in the back of the book and send us the driver's exercises to examine and certify.

SPECIAL NOTICE: On December 2, 2005 Federal District Court affirmed the Part 380 training. This training rule will be expanded in the future, so NOW is the time to complete this training.

WHO NEEDS TO PURCHASE THIS NEW CDL DRIVER QUALIFICATION TRAINING GUIDE or TRAINING DVD:

All companies or organizations, (private or for hire), that hire one or more "new" (drivers obtaining a CDL after July 20, 2003) INTERSTATE CDL drivers. All self-employed, owner-operators or independent contractors with "new" CDLs (CDLs obtained after July 20, 2003) that drive interstate (or continue to move an interstate shipment). See 49 CFR 380.501

All companies or organizations with new CDL INTRASTATE drivers whom are domiciled or licensed in the states of Colorado, Illinois and Texas. NOTE: Your state may have already adopted this Federal driver qualification training rule.

Six Numbered Certificates with Answer Key Order No. 380C $19.95

An "Entry-Level Driver Training Certificate" is required under 49 CFR 380.505. After drivers complete the required entry-level training (49 CFR Part 380), a copy needs to be given to the driver and a copy placed in the driver's qualification or personnel file.
